For the functionality of the website and mobile application, to optimize both, and to ensure the security of the information technology systems of ORATIS. For the integration of social plugins and social share functions. (Legal basis is the legitimate interest of ORATIS, to comply with the request of members who have activated a social plugin to share their information with the appropriate social network.)

3. What Others May See About You

We think our Users are unique, and we want you to share how unique you are with the world, so we have built certain features to enable this. Our App is designed to make it easier for you to connect with other Users and to interact with them.

When using the ORATIS App, you should assume that anything you post or submit on the App may be publicly-viewable and accessible, both by Users and non-users of the App. We want our Users to be careful about posting information that may eventually be made public.

Please be careful about posting sensitive details about yourself on your profile such as your religious denomination and health details. You may also choose to add sensitive information about yourself when you add certain ORATIS badges to your profile, such as your religion and political leanings. While you may voluntarily provide this information to us when you create your profile, including your sexual preferences, there is no requirement to do so. Please remember that photographs that you post on ORAITS may reveal information about yourself as well. Where you do upload and choose to tell us sensitive information about yourself, including through the addition of badges to your profile, you are explicitly consenting to our processing of this information and making it public to other Users.

Your ORATIS profile and other information you make available via the App, including certain information added to your profile may be viewed and shared by Users with individuals who may or may not be users of the App. For example, a User may recommend you as a match to his or her Facebook friend(s) by taking a screenshot of your profile picture and sharing it, regardless of whether such friend(s) is also a User of the App.

4. Policy Towards Age

Although we want as many people as possible to enjoy our creation, you have to be at least 18 years old to use the App – sorry kids, we know ORAIS is cool, but you’ll have to come back when you’re old enough!

ORATIS does not knowingly collect any information about or market to children, minors or anyone under the age of 18. If you are less than 18 years old, we request that you do not submit information to us. If we become aware that a child, minor or anyone under the age of 18 has registered with us and provided us with personal information, we will take steps to terminate that person’s registration.

5. Security

Here at ORATIS, we pride ourselves on taking all appropriate security measures to help protect your information against loss, misuse and unauthorized access, or disclosure. We use reasonable security measures to safeguard the confidentiality of your personal information such as secured servers using firewalls.

Unfortunately, no website or Internet transmission is ever completely 100% secure and even we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur, but here are some handy tips to help keep your data secure:

  1. Please make sure you log out of your Account after use as you never know who may stumble onto your Account!
  2. Please don’t share the password you use to access your ORATIS Account with anyone else!
  3. Change your password periodically.

We cannot guarantee the security of your personal data while it is being transmitted to our site and any transmission is at your own risk.

6. Disclosure of Information

Transfer of data to third parties, service provider

Your personal data will only be given to third parties by ORATIS if it is necessary for the fulfillment of the contract or if your consent is obtained. If personal data is transmitted to third parties on the basis of legitimate interest, we explain our legitimate interest in this privacy policy. In addition, personal data may be transferred to third parties, as far as ORATIS is obliged to act in such manner due to legal regulations or enforceable official or court orders.

Service Providers

We engage certain trusted third parties to perform functions and provide services to us (“Service Providers”). The suppliers with which ORATIS shares User personal data vary depending on a variety of factors, such as which of our App, Sites and services a User engages with. For example, to provide our services to Users, we typically use the following suppliers:

  • Billing services – to allow customers to purchase paid features of our App (for example, Google Play)

We carry out due diligence on all Service Providers we engage to ensure they have adequate data protection and information security measures in place and only provide them with the personal data necessary to the service they are providing. Measures are taken to ensure that the data shared is non-attributable to the greatest extent possible and our suppliers are also subject to extensive obligations under our contractual arrangements, including strict data retention limits.

Transfer of data to non-EEA countries

In exceptional cases, ORATIS will also share personal information with a processor located in a non-EEA country. The servers of this service provider are located within the EU. However, as part of a long-term care contract, this software supplier has the opportunity to access the software systems through specialists based outside the EU. ORATIS has ensured that the recipient has an adequate level of data protection prior to disclosure (by demonstrating the recipient’s certifications and by agreeing to the EU’s standard contractual clauses with the recipient).

You may receive further information from ORATIS, as well as a copy of the specific arrangements agreed upon to ensure the appropriate level of data protection. Please use the information in the section Contact.

Duration of storage; Retention periods

We store member data for as long as necessary for the provision of our online offer (i.e., basic and premium membership) and the associated services or because we have a legitimate interest in the further storage of member data. In all other cases, we will erase your personal information except for the information stated above, as we may need to maintain certain member information in order to fulfill contractual or statutory (e.g., tax or commercial) retention periods (e.g., invoices).

For basic members: You can object to the storage of personal data contained in your profile at any time without any future effect. You can also erase your profile data yourself. For basic members who are inactive for 24 months, ORATIS automatically erases personal profile data.

For Premium members: The personal data of ORATIS Premium members are always stored for the duration of the contract. If you ask us to do so, we will erase your data as long as there is no statutory storage obligation for such data. For data that is subject to a retention period, this data will remain locked until the expiry of the retention period. If you do not ask us to erase your data until the end of the Premium Membership, your premium membership will be converted into a basic membership. The previously stated information on the duration of the storage of basic member data would then apply.

In the context of the assertion of data subject rights, ORATIS stores such data, which are necessary for fulfillment or proof during the limitation period.

Marketing Services Providers

We partner with providers of marketing services (such as Facebook for example) (‘Marketing Services Providers’) to help us market and advertise our App and services on third party websites and applications and measure the effectiveness of our advertising campaigns. For example:

  • to exclude you from advertising campaigns aimed at finding new users, if you already have a ORATIS account;
  • to show ORATIS adverts to users who have visited the ORATIS App/Sites but haven’t yet created a ORATIS account;
  • to create an audience for our advertisements of other potential users who have similar characteristics to you based on the information the Marketing Service Providers holds about you (also known as a Lookalike Audience); or
  • to include you in a ‘custom audience’ that will receive ORATIS advertising content (a custom audience is essentially a list of people who we think are most likely to be interested in a particular advertisement).

We share a limited amount of your personal data with these Marketing Services Providers, such as:

  • the advertising identifier associated with your device (this is a random number assigned by your mobile device manufacturer (for example Apple or Google) to your device to help advertisers (including the manufacturer) know when an ad has been viewed or clicked in an app, and when an ad causes a ‘conversion’ (for example, downloading the app advertised to you)
  • your estimated location (based on your IP address)
  • age and gender
  • data about your visit to our Sites or App and action taken on those (for example if you downloaded our App or created an account with our App)
  • a hashed* version of your email address (to create ‘custom audiences’).

*Hashing is a way of encrypting information by turning it into a combination of random numbers and letters – this code cannot be traced back to the email address. When hashed email addresses are sent to a Marketing Service Provider, they’re then matched against the Provider’s own existing list of their own users’ hashed information and our ads are served to those of our users who have successfully been matched with the Provider’s. Matched and unmatched hashes are then deleted by the Provider.

For more information about how we use cookies and other tracking technologies, including how you can set and manage your preferences with regards to such technologies, please see our Cookie Policy below.

In some cases, these third parties will also use the data that they collect for their own purposes, for example they may aggregate your data with other data they hold and use this to inform advertising related services provided to other clients.

Facebook

Where we share data with Facebook as our Marketing Service Provider (including via the Facebook “Like” function), we are Joint Data Controllers with Facebook Ireland for this processing. This arrangement means that ORATIS has to provide you this notice, but you should contact Facebook if you wish to exercise your data protection rights. Further information, including how Facebook enables you to exercise your data protection rights, and subsequently processes your information as independent data controller can be found in Facebook Ireland’s Data Policy. If you want more information relating to the nature of the arrangement we have in place with Facebook, please email office@oratis.app

This data referred to above can include actions that you take on our website such as your interactions with our Sites or other information collected from cookies or similar technologies including the Facebook pixel. This allows us to measure the effectiveness of our advertising, improve our marketing practices, and helps us deliver more relevant advertising to you and people like you (including on social media such as Facebook).

7. Legal Basis For The Process of Personal Data

Insofar as we obtain the consent of the data subject for processing of personal data, Art. 6 paras. 1 lit. a EU General Data Protection Regulation (GDPR) is the legal basis.

When personal processing data required to fulfill the contractual relationship of ORATIS (e.g., basic membership or premium membership), Art. 6 paras. 1 lit. b DSGVO is a legal basis. This also applies to processing data required to execute pre-contractual actions.

If processing is necessary to safeguard the legitimate interest of ORATIS or a third party, such as its members, and member interests, fundamental rights, and freedoms of the data do not prevail over the first-mentioned interest, Art. 6 paras. 1 lit. f DSGVO which presents a legal basis for processing.

Rights of the data subject

You, as a member, have the right of access and, under certain conditions, to rectification, erasure, restriction of processing, or to object to the processing of your personal data and to data portability via written request to the ORATIS team.

You can also object at any time to the processing of your personal data for advertising purposes (i.e., “object to advertising”). Please take into account that for organizational reasons, there may be an overlap between your assertion of your right to object and the use of your data as part of an ongoing campaign.

You have given us your information about your sexual orientation (i.e., gender and sex). You can assert your right to object to this consent at any time, an action that will take effect in the future. The lawfulness of the processing of your data until the assertion of your right to object remains unaffected from the moment that your withdrawal partner suggestions can no longer be made and ORATIS can no longer provide service.

Please use the information under “Contact” to assert your rights. Please make sure that we can clearly identify you.

Alternatively, you can use the setting options in your profile to rectify your data that you provided during registration or for your objection to advertising. You can also erase the data of your ORATIS base membership yourself. Erasure of premium membership data can only be initiated through ORATIS Customer Service. Please note that your data will initially only be blocked if the erasure is prevented by retention periods.

9. Cookies & Web Tracking

This website mobile application uses cookies. Specifics as to which cookies are used can be found here.Cookies are small text files that are sent when you visit a website and stored in the browser of the user. If the corresponding Internet page is retrieved, the browser of the user sends back the content of the cookies and thus enables a recognition of the user. Certain cookies are automatically erased after the end of the browser session (i.e., session cookies). Others are stored for a predetermined time or permanently in the user’s browser and then erase themselves (i.e., temporary or permanent cookies).

In cookies, no personal data is stored, but only an online identifier.

What kind of cookies does ORATIS use?

Essential cookies

Certain cookies are required to make our online offer safe and easy to use. This category includes:

Cookies that serve to identify or authenticate our users;

Cookies that temporarily store certain user entries;

Cookies that store certain user preferences.

Analysis cookies

We use analysis cookies to record the usage behavior (e.g., visited subpages) of our users and to evaluate usage behavior in statistical form.

Third-Party Advertising Cookies / Third Party Pixel / Third Party Tracking

We allow other companies to collect our users’ data through advertising cookies or pixels. This allows us and third parties to provide users of our online offering with interest-based advertising, based on an analysis of usage behavior (e.g., clicked banner ads, visited subpages) as a whole and not limited to our online offering.

How can you prevent the use of cookies or erase cookies?

You can use ORATIS via our mobile application, free from advertising cookies and analysis cookies. In this case, only the essential cookies that are necessary for the use of the website are utilized.

Alternatively, you can deactivate the storage of cookies via your browser settings and erase already stored cookies at any time in your browser (see Technical Notes). However, please note that this online offer without cookies may not work or may only work with limitations.

We also recommend the website of www.YourOnlineChoices.com, where you can obtain information and seek assistance in connection with web tracking mechanisms.

Web Analytics

We need statistical information about how we use our online offering to make it more user-friendly, measure reach, and conduct market research. For this purpose, we use the following web analytics tools. The tools either do not utilize users’ IP addresses at all or truncate them immediately after the survey. The usage profiles generated by the tools using analytic cookies or by evaluating the log files are not merged with personally identifiable information. The providers of the tools process data as processors according to our instructions and not for their own purposes.

The specific cookies/pixels that are used can be found here. In addition to the Name of the individual cookies/pixels, we have also listed the intended use and other important information here. You can use ORATIS via our mobile application, free from advertising cookies and analysis cookies.

Google Analytics

This website and mobile application use Google Analytics, a web analytics service provided by Google Inc. (i.e., “Google”). Google Analytics uses cookies that are stored on your computer and that allow an analysis of your use of the website and mobile application. These are cookies from Google itself (i.e., Google Analytics cookies). ORATIS uses Google Analytics with the additional feature offered by Google for the anonymization of IP addresses: Google’s IP address is usually already shortened within the EU; in exceptional cases, only in the US; and in any case, it is only in abbreviated form. On behalf of ORATIS, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website activity and Internet usages, such as Google Analytics demographics and interest reports, to provide to ORATIS. How Google processes data is described here: https://privacy.google.com/businesses/processorterms/.

Unused by ORATIS will be the Google Analytics Advertising Features.

You can use ORATIS via our mobile application free from advertising cookies and analysis cookies. In this case, only the essential cookies that are necessary for the use of the website are utilized.

Using Google Adwords Conversion Tracking

ORATIS uses the Google AdWords online advertising program and Google AdWords conversion tracking. Google Conversion Tracking is an analytics service provided by Google Inc. (1600 Amphitheater Parkway, Mountain View, CA 94043, USA; i.e., “Google”). When you click on an ad served by Google, a conversion tracking cookie will be placed on your machine. These cookies lose their validity after 390 days, contain no personal data, and are therefore not used for personal identification. If you visit certain web pages on our website and the cookie has not expired, Google and ORATIS may recognize that you clicked on the ad and were redirected to this page. Each Google AdWords customer receives a different cookie.

The information gathered using the conversion cookie is utilized to generate conversion statistics for AdWords advertisers who have opted for conversion tracking. This system notifies customers of the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, they do not receive information that personally identifies users.

You can use ORATIS via our mobile application, free from advertising cookies and analysis cookies. In this case, only the essential cookies that are necessary for the use of the website are utilized.

Use of Google Adwords remarketing function

ORATIS uses the remarketing or “similar target group” function of Google Inc. (i.e., “Google”). This feature allows ORATIS to target visitors to the website with advertising by delivering personalized, interest-based ads to ORATIS visitors when they visit other websites on the Google Display Network or use Google’s or a partner’s search function. Google uses cookies to analyze website usage, which forms the basis for creating interest-based advertising. To achieve this, Google saves a small file with a sequence of numbers in the browsers of ORATIS users. The sequence of numbers is used to record ORATIS visits. We also collect anonymous data about the use of ORATIS. No personal data of visitors to ORATIS is stored. If users subsequently visit other websites on the Google Display Network or the search function of Google or a partner, ORATIS will display advertisements to visitors that are highly likely to include previously accessed product and information areas.

You can permanently deactivate the use of cookies by Google by following the link below and downloading and installing the plugin provided there: https://tools.google.com/dlpage/gaoptout?hl=. Alternatively, you can disable the use of cookies by third parties by visiting the deactivation page of the Network Advertising Initiative at http://www.networkadvertising.org/choices/ and implementing the additional opt-out information mentioned there. For more information about Google Remarketing and Google’s privacy policy, please visit http://www.google.com/privacy/ads/

Facebook Remarketing

ORATIS uses remarketing technologies for ad impressions on Facebook, especially the products Custom Audiences and Website Custom Audiences. Through this technology, users who have already visited ORATIS and are interested in the offer are being targeted by ad advertising on Facebook through ad impressions. The advertising is displayed by the use of cookies, with the help of user behavior, when visiting the website and can be analyzed and subsequently used for targeted product recommendations and interest-based advertising. Information about the activities of the user on the website of ORATIS, such as Surfing behavior, previously visited sites, etc. The transmitted IP address of the user’s computer is stored and used for the geographical control of advertising.

You can use ORATIS via our mobile application free from advertising cookies and analysis cookies. In this case, only the essential cookies that are necessary for the use of the website are utilized.

Tractor audience measurement

Our website uses the measuring method (“SZMnG”) of INFOnline GmbH (https://www.INFOnline.de) to determine statistical parameters on the use of our offers. The aim of the usage measurement is to determine the number of visits to our website, the number of website visitors, and their surfing behavior, which are statistically analyzed – based on a uniform standard procedure – and used to obtain comparable values across the market.

For all digital offers that are members of the Information Society for the Determination of the Dissemination of Advertising Media (IVW – http://www.ivw.eu) or in the studies of Arbeitsgemeinschaft Online-Forschung eV (AGOF – HTTP: // www. agof.de), the usage statistics are regularly further processed by the AGOF and the Arbeitsgemeinschaft Media-Analyze eV (agma – http://www.agma-mmc.de) into ranges and published with the performance value “Unique User” and by the IVW with the performance values “Page Impression” and “Visits.” These ranges and statistics can be viewed on the respective websites.

The INFOnline GmbH collects the following data, which according to EU-DSGVO, have a personal reference: IP address. On the Internet, each device requires a unique address for the transmission of data, the so-called IP address. The temporary storage of the IP address is technically necessary due to the functioning of the Internet. The IP addresses are shortened by 1 byte before any processing and processed in a fully anonymous fashion. There is no storage or further processing of the unabridged IP addresses.

A randomly generated client identifier: In order to recognize computer systems, reach processing alternatively uses either a cookie with the ID “ioam.de,” a “Local Storage Object,” or a signature that is created from various automatically transmitted information from your browser. This client identifier is unique to a browser as long as the cookie or local storage object is not erased. Therefore, measuring the data and then assigning it to the respective client identifier is also possible if you access other web pages that also use the measurement method (“SZMnG”) of the INFOnline GmbH. The measurement procedure of INFOnline GmbH, which is used on the ASTRODITA website, determines usage data. This is conducted to collect the performance values of page impressions, visits, and clients and to provide additional metrics (e.g., qualified clients). In addition, the measured data is used as follows:

A so-called geo-localization (i.e., the assignment of a website call to the place of the call) takes place exclusively on the basis of the anonymized IP address and only up to the geographical level of the federal states/regions. From the geographic information obtained in this way, in no case can a conclusion be drawn on the specific location of a user.

The usage data of a technical client (e.g., a browser on a device) are merged across web pages and stored in a database. This information is used for the technical assessment of socio-information age and gender and passed on to the service providers of AGOF for further range processing.

The AGOF study uses a random sample to technically estimate societal characteristics that fall into categories inclusive of age, gender, nationality, occupation, marital status, household information, household income, place of residence, internet usage, online Interests, place of use, and user type.

The complete IP address will not be saved by INFOnline GmbH. The shortened IP address is stored for a maximum of 60 days. The usage data in connection with the unique identifier are stored for a maximum of 6 months.

The IP address as well as the shortened IP address will not be forwarded. For the preparation of the AGOF study, data with client identifiers are forwarded to the following service providers of AGOF: Kantar Deutschland GmbH (https://www.tns-infratest.com/), Ankordata GmbH & Co. KG (HTTP: // www.ankordata.de/homepage/), Interrogare GmbH (https://www.interrogare.de/).

You can use ORATIS via our mobile application free from advertising cookies and analysis cookies. In this case, only the essential cookies that are necessary for the use of the website are utilized.

Social Plugins

The integration of social plugins regularly leads to the providers of the plugins storing cookies. The various providers of plugins are summarized below under the term “plugin provider.”

In order to increase the protection of your data when visiting our online service, the plugins are integrated into the site via the so-called “Sheriff solution.” This ensures that when you call up a page of this online offer, no connection is established with the servers of the respective plugin provider.

Only when plugins are activated by the user does your Internet browser establish a direct connection to the servers of the respective plugin provider. This gives the plugin provider the information that your Internet browser has accessed the corresponding page of our online service, even if you do not have a user account with the provider or are currently not logged in. Log files (including the IP address) are transmitted from your Internet browser directly to a server of the respective plugin provider and possibly stored there. This server may be located outside the EU or the EEA (e.g., in the USA).

The plugins represent independent extensions of the plugin providers. Therefore, we have no influence on the extent of the plugin providers collected and stored by the plugin’s data.

If you do not want the plugin providers to receive the data collected via this Internet portal, nor do you want to save or re-use them, you should not use the respective plugins.

In other words, you can completely prevent the plugins from being loaded with add-ons for your browser (i.e., script blockers).
